Registration ensures protection of your unique logo/ brand by restricting usage by other competitors as identical/ similar marks cannot be registered. Trademark owners have the right to use their mark exclusively or a period of 10 years from the date of registration.

The following documents are essential for Trademark Registration.

Identity Proof of Authorised Signatory: Proof such as Passport, Drivers License, Voters Identity and Aadhaar Card of the Authorised Signatory of the Trademark Application.
Proof of Registration: If the trademark application is filed on behalf of a corporate entity, then the Partnership Deed, Incorporation Certificate or the Registration Certificate is required.
Singed Form 48: Form 48 is a legal document that authorises an Attorney to file a trademark application of your behalf with the Trademark Register.
Logo and User Affidavit: Logo, if required in the black and white format. If the trademark has been used before, the applicant must submit an user affidavit to the concerned Authorities.

Trademark Search:

India eSeva will assist you in verifying your brand name availability. We will ensure that you have your desired trade name which is not similar or identical to any other existing trademark. You may conduct a self-search for your desired trademark on our extensive registered trademarks database as well.

Application:

Once the trademark search is complete, India eSeva will begin the preparation of your trademark application as per your requirements. An authorisation letter will be sent to you in order to review and confirm the Trademark Name and Class information. Once we receive the confirmation from your side, India eSeva will file it with the Trademark Registrar. Once the filing is complete and you receive the trademark application number, you may start using the same along with the TM symbol.

Registration:

Soon after the trademark application is prepared and finalised with your approval, India eSeva will file the same with the Trademark Registry. Once the process of filing is completed and you receive the application number, you may start using the trademark along with the TM symbol.

The Trademark Registrar will start processing your application once it is filed. However, if the trademark is similar to another in the same trademark class as yours or if the trademark is objectionable, we may have to file rectification for the same.

The application will be published in the Trademarks Journal if no objections are raised. The application would be processed within the next 8 months and registered successfully if no opposition is filed by a third-party.
